General Terms and Conditions (GTC)
This is a convenience translation. The German version shall prevail.
§ 1 Scope of application
(1) These General Terms and Conditions (GTC) apply to all orders placed by consumers via the online shop best-supps.de with XVXII Diamond GmbH, Fasangasse 36, 2423 Deutsch Jahrndorf, Austria, commercial register number FN 495883 s, VAT ID ATU73498734 (hereinafter "we" or "Seller").
(2) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.
(3) The product range of our online shop is directed at customers with a delivery address in the delivery countries offered during checkout (in particular Germany and Austria as well as other countries selectable at checkout).
§ 2 Conclusion of contract
(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the button "Buy now" / "Order with obligation to pay" in the final step of the checkout process, the customer submits a binding offer to conclude a purchase contract for the goods contained in the shopping cart.
(3) The contract is concluded when we accept the order by sending an order confirmation by e-mail or by dispatching the goods. The automatic order receipt confirmation merely documents that the order has been received and does not constitute acceptance.
(4) The text of the contract is stored by us. The order data and these GTC are sent to the customer by e-mail. The contract language is German.
§ 3 Prices and payment
(1) All prices stated are final prices in euros and include the applicable statutory value added tax. Any shipping costs pursuant to § 4 are added.
(2) Payment is made via the payment methods offered during checkout (in particular PayPal, credit/debit card, Apple Pay, Google Pay and other payment services displayed at checkout).
(3) For payment methods where payment is initiated directly during the ordering process (e.g. PayPal, credit/debit card, Apple Pay, Google Pay), the contract is concluded – in deviation from § 2 (3) – upon completion of the ordering process.
(4) If an advance payment method is selected, the purchase price is due upon conclusion of the contract.
§ 4 Shipping costs
(1) Shipping costs may apply in addition to the stated product prices. The amount of the shipping costs per delivery country is set out in our shipping information ("Shipping & Returns" page) and is displayed during checkout before the order is placed.
(2) Any thresholds for free shipping are also set out in the shipping information.
§ 5 Delivery and delivery time
(1) Delivery is made by dispatch from our shipping location in Germany (XVXII Diamond GmbH – Warehouse, Am Schäfflerbach 11, 86153 Augsburg) to the delivery address provided by the customer.
(2) The delivery time is generally 5 to 9 business days after conclusion of the contract or – in the case of advance payment – after receipt of payment. We source the goods from our wholesaler on an order-by-order basis; the stated delivery time already takes this process into account.
(3) If, contrary to expectations, an item is unavailable, in particular because we have not been supplied by our supplier through no fault of our own, we will inform the customer without delay and immediately refund any payments already made for that item.
(4) We reserve the right to reject orders in the event of an obvious pricing or display error, indications of abusive ordering behaviour, or orders of quantities exceeding normal household amounts.
(5) Transport damage: If goods are delivered with obvious transport damage, please report such damage to the delivery agent immediately if possible and contact us at shop@best-supps.de. Failure to make such a complaint has no consequences for your statutory warranty rights – however, it helps us to assert our own claims against the carrier.
§ 6 Retention of title
The goods remain our property until payment has been made in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal of 14 days. Details are set out in the instructions on withdrawal (available in the shop under "Right of Withdrawal"). The right of withdrawal expires in the case of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery; it does not apply to goods that are liable to spoil quickly or whose expiry date would quickly be exceeded.
§ 8 Warranty
(1) The statutory warranty rights apply.
(2) For consumers, the warranty period for new goods is two years from delivery of the goods.
§ 9 Liability
(1) We are liable without limitation for damage resulting from injury to life, body or health, as well as in cases of intent and gross negligence.
(2) In cases of slight negligence, we are only liable for the breach of essential contractual obligations (obligations whose fulfilment is a prerequisite for the proper performance of the contract in the first place), and liability is limited in amount to the damage typically foreseeable under the contract.
(3) Liability under mandatory statutory provisions (in particular product liability law) remains unaffected.
§ 10 Information on food supplements
Food supplements are not a substitute for a balanced, varied diet and a healthy lifestyle. The recommended daily intake stated on the products must not be exceeded. Store products out of the reach of children.
§ 11 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 12 Final provisions
(1) Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country of their habitual residence.
(2) Should individual provisions of these GTC be invalid, the remainder of the contract shall remain valid.
